The new draft Standard is claimed to preserve the same risk allocation as that which underlies the existing Standards, but there are significant differences proposed for the new Standard see summary below.

It remains to be seen whether, where there is an inconsistency between the Standard and the Act, the proposed changes will be effective. For example, a document is only a payment schedule under the SOP Acts if it satisfies the criteria in the Acts, and purporting to contractually deem a document a payment schedule will not overcome non-compliance with the Act.

The Main Contractor will be required to use AS subcontract conditions, containing no other amendments or additions to those subcontract conditions, except those necessary to reflect the Contract between the Principal and the Contractor.
